Acceptable Use Policy

1. Introduction

This Acceptable Use Policy ("AUP") governs your use of Beyond Divergent and the products and services offered through https://www.beyonddivergent.com (collectively, the "Services").

By accessing or using the Services, you agree to comply with this AUP. If you do not agree, do not use the Services. We may modify this AUP at any time; continued use after changes constitutes acceptance.

2. Permitted Use

You may use the Services only for lawful purposes and in accordance with these terms. You agree to use the Services:

  • In compliance with all applicable local, national, and international laws and regulations
  • In a manner that does not infringe or violate the rights of others
  • In good faith and for the purposes for which the Services were intended
  • In accordance with any additional guidelines posted on the Site

3. Prohibited Activities

You are expressly prohibited from using the Services to:

  • Engage in illegal activity of any kind under applicable law
  • Harass, bully, intimidate, or threaten any other users, clients, or third parties
  • Send spam or unsolicited bulk messages, advertisements, or promotional materials
  • Distribute malicious software (viruses, worms, trojans, ransomware, or other harmful code)
  • Attempt unauthorised access to any part of the Services, other accounts, or connected systems
  • Scrape or data-mine the Services using automated tools without our prior written consent
  • Impersonate any person or entity, or misrepresent your affiliation
  • Infringe intellectual property by copying, redistributing, or creating unauthorised derivative works of our content
  • Interfere with the Services by overloading, attacking, or disrupting their integrity or performance
  • Engage in fraud or any deceptive, misleading, or unauthorised commercial practices

4. Content Standards

If you post, upload, or share any content through the Services (including in coaching sessions, intake forms, or testimonials), that content must not:

  • Be defamatory, obscene, offensive, hateful, or inflammatory
  • Promote sexually explicit material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, gender identity, or age
  • Infringe any copyright, database right, trademark, or other intellectual property right
  • Be designed to deceive or impersonate any person
  • Breach a legal duty owed to a third party (e.g., a duty of confidence)
  • Promote any illegal activity or assist any unlawful act
  • Contain unauthorised advertising or promotional content
  • Contain personal data of others without their explicit consent

5. Monitoring and Enforcement

We reserve the right, but are not obligated, to:

  • Monitor use of the Services for violations of this AUP
  • Remove or refuse to post any content that violates this AUP, at our sole discretion
  • Take any action we deem necessary to protect the integrity and security of the Services
  • Cooperate with law enforcement, court orders, or regulators where required

6. Reporting Violations

If you become aware of a violation, please report it to hello@beyonddivergent.com. When reporting, include your contact information, a description of the issue, supporting evidence, and the URL where it occurred (if applicable). We aim to respond within 5 business days.

7. Consequences of Violation

Violation of this AUP may result in any combination of:

  • A formal warning
  • Temporary or permanent suspension of access to the Services
  • Removal of offending content
  • Termination of any coaching engagement, with or without refund (per the Refund Policy)
  • Legal action, including damages and injunctive relief
  • Reporting to relevant authorities

We may take these actions without prior notice. The response will be proportionate to the nature and severity of the violation.

8. Indemnification

You agree to indemnify, defend, and hold harmless Beyond Divergent and its agents from any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from your violation of this AUP or your use of the Services.
